1. CALL TO ORDER

The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, September 17, 2018 at 8:04 p.m. with Chair, Jim Burke presiding.

2. RECORD OF ATTENDANCE

Members in attendance were Chair, Jim Burke, Chyann Kirby, Alex Calvin, Theresa Gordon, Brittany Merrifield, Cllr. Bev Day and Acting Development Officer, Bruce Gault.

Member absent was Ron Daigle.

Applicant, Erin Riley, was not present.

“…moved by Cllr. Bev Day that the Planning Advisory Committee Deny Application for Similar & Compatible Use/Discretionary Use, 15 Maplecrest Drive….”

Seconded by Chyann Kirby. Carried.
The interested parties in attendance were advised that this area is zoned R1 and R2, and not just for single family, and that a Similar & Compatible Use (ie: Group Home), is listed as one of the permitted uses in the Town’s Zoning By-law.

Regarding the Covenants, Cllr. Bev Day read out loud the Development Officer’s Memo dated September 13, 2018, addressing concerns for Residential Covenants reviewed with Town Solicitor Poley.
As stated in the memo, the Town is free to make decisions based on the By-laws of the Town and due to the fact, the Applicant once again was not present to clarify any unanswered questions, the Committee could choose to deny the Application.

The Applicant now has the option of making an appeal with the Provincial Planning Appeal Board or coming back to PAC with a different Application, or the same Application after one year. In which case, the neighboring property owners would once again be advised of an Application being made.

8. APPLICATION FOR VARIANCE
RE: JANE & JONATHAN WEBB – 244 INGLEWOOD DRIVE
(A) DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 17, 2018

Applicant, Jane Webb, was present and addressed the Committee as follows:

Her Application is to add an extension for an entryway on the existing residence;
due to limited space, she is requesting a Variance regarding the side yard setback.

There was on one present speaking in favor of or against this Application.

“…moved by Cllr. Bev Day that the Planning Advisory Committee APPROVE the following Variance for the purposes of building an addition to the side and rear of the main building PID No. 30099113, Civic No. 244 Inglewood Drive, as shown on the Preliminary Site Plan,

i) under Section 8.3.1.2 (f), to grant a Variance of 0.91 m to reduce the minimum required side yard setback from 3.5 m to 2.59 m;
ii) approve the reduced setback requirements from the regulated 30 m setbacks from Provincially Significant Wetlands to permit an existing Accessory Building to be relocated to within 16 m of the wetland, and for construction of the rear addition to the upper floor of the existing building, to be supported on posts below frost, to extend to within 20 m of the wetlands per conditions set out in Document “A” WAWA Alt 43677’18 Revision dated August 16, 2018….”

Motion seconded by Alex Calvin. Carried.

9. APPLICATION FOR VARIANCE
RE: ADAM BURLEY – 595 NEREPIS ROAD
(A) DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 17, 2018

Applicant, Adam Burley, was present and addressed the Committee as follows:

He has just built a new home on a large parcel of land with a 1500-foot driveway;
to maintain his property, he needs a good size storage building to house all his personal equipment.

There was on no one present speaking in favor of or against this Application.

“…moved by Alex Calvin that the Planning Advisory Committee APPROVE the following Variances to construct an Accessory Building, under Section 5 of the Town’s Zoning By-law No. 112, as located per submitted Site Plan on Civic No. 595 Nerepis Road, PID Nos. 30308837/30308829; the request is seen as being reasonable under the circumstances, where the property consists of more than 30 ha (75-acres) of land with 146 m frontage on Nerepis Road, and a driveway length of over 350 m (1150 ft) with an inclining grade of 40 m (130 ft);

i) grant a Variance of 36 m² (387 ft) to increase the maximum total area of Accessory Buildings from 75 m² to 111 m²; and

ii) grant a Variance of 1.93 m (6.5 ft) to increase the overall height of the Accessory Building from 6.0 m to 8.93 m….”

Seconded by Theresa Gordon. Carried.
