1. CALL TO ORDER

The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, November 21, 2016 at 8:00 p.m. with Chair, Ralph Stevens presiding.

2. RECORD OF ATTENDANCE

Members absent were Ron Daigle and Theresa Gordon.

3. PLANNING ADVISORY COMMITTEE MEETING MINUTES OF OCTOBER 3, 2016

4. REGULAR COUNCIL MINUTES OF SEPTEMBER 26, 2016, OCTOBER 11, 2016 AND OCTOBER 24, 2016

“…moved by Cllr. Bev Day to receive and file the Regular Council Minutes of September 26, 2016, October 11, 2016 and October 24, 2016 ….”

Seconded by Jim Burke. Carried.

7. APPLICATION FOR TENTATIVE SUBDIVISION APPROVAL
RE: MAGUIRE EXCAVATING LTD. – PANORAMIC ESTATES SUBDIVISION PHASE 7, EXTENSIONS – JUNE & BOYD AVE.
(A) DEVELOPMENT OFFICER’S REPORT DATED NOVEMBER 17, 2016

The Applicant was not present, and there was no one present speaking in favor of or against this Application.

1. “… moved by Chyann Kirby that the Planning Advisory Committee recommend Tentative Approval for Council to accept Tentative Subdivision Plan, Panoramic Estates Phase 7, as prepared by Kierstead Quigley & Roberts Ltd., dated September 12, 2016;

subject to:

a)approval of the street design, subject to review and final recommendation of approval to be submitted to Council:

i)by Dillon Consulting Ltd. (acting as the Town Engineer),
ii)with approval being granted by the Department of Environment & Local Government for extension of sanitary sewer services to these 5 lots;

b)and subject to approval of the following general conditions prior to consideration of registration of a Developer’s Subdivision Agreement with Final Approval of the Subdivision Plan:

i) civic addresses to be identified on the Final Plan for NB911 identification;
ii) Utility easements recorded on the Plan and signed by NB Power;
iii) Developer’s Cost Estimate to be confirmed by Dillon Consulting Ltd., and execution of an Irrevocable Letter of Credit in favor of the Town in that amount.…

2. … move that the Planning Advisory Committee recommend to Council the acceptance of $114.08, money in lieu of Land for Public Purposes (cash, debit, money order or certified cheque) for the creation of five new building lots as shown on the Tentative Subdivision Plans, Panoramic Estates Subdivision Phase 7 as prepared by Kierstead Quigley & Roberts Ltd., dated September 12, 2016…

3. …move that the Planning Advisory Committee approve of the name of the proposed street name as June Avenue, and Boyd Drive as shown on Tentative Subdivision Plan, Panoramic Estates Subdivision Phase 7, as prepared by Kierstead Quigley & Roberts Ltd. dated September 12, 2016 and recommend to Council to assent to those names being recorded as PUBLIC on the Final Subdivision Plan….”

8. APPLICATION FOR VARIANCE
RE: CRAIG & AMBER WELSHMAN, 14-16 APPLE HILL ROAD
(A) DEVELOPMENT OFFICER’S REPORT DATED NOVEMBER 17, 2016

Applicants, Craig and Amber Welshman, were present and stated they had nothing further to add to their Application. However, they advised that they are the sellers of the property in question and that they were not aware of these pre-existing conditions when they purchased the house.

There was no one present speaking in favor of or against Application.

“… moved by Cllr. Bev Day that the Planning Advisory Committee approve the following Variances to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 112, for the location of existing structures (main dwelling, Accessory Structure and access stair), located at 14-16 Apple Hill Road, PID No. 226118:

i) under Section 4.9.5 (b), grant a Variance of 0.97 m to increase the permitted projection for the stair into a side yard from 1.8 m to 2.77 m;
ii) under Section 5.1.3 (b), grant a Variance of 1.45 m to reduce the side yard setback for the shed from 1.5 m to 0.05 m;
iii)under Section 8.2.2.3 (f), grant a Variance of 1.47 m to reduce the side yard setback for the main building from 3.5 m to 2.03 m….”
