By-Law No. 77

The Council of the Municipality of Grand Bay-Westfield under authority vested in it by Section 187 of the Municipalities Act, R.S.N.B. 1973, c.M-22 and amendments thereto enacts as follows:

All that certain portion of public street known as Prosser Court as described by the attached Schedule ‘A’, Plan of Survey, prepared by DeSaulniers Surveys Inc., dated January 9, 2001 and more particularly described as follows will on the enactment of this by-law be closed to public use:

PARCEL “A”

PORTION OF PROSSER COURT TO BE CLOSED

All and singular that certain lot, piece or parcel of land situate lying and being in the Town of Grand Bay-Westfield, Parish of Westfield, County of Kings and Province of New Brunswick, said lot being more particularly described as follows, viz:

Beginning at a standard survey monument marking the northeastern corner of Lot 74-5 (PID 460949) as shown on a subdivision plan registered in the Kings County registry office as Plan No. 4506. Said point of beginning having New Brunswick Grid Coordinate Values (NAD83CSRS) of east-2,520,008.053 metres and north-7,373,266.787 metres and being designated as station No. 480 on a Plan of Survey showing Discontinuance of Parcel “A” (Prosser Court), situate, Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick, prepared by DeSaulniers Surveys Inc. and dated January 9, 2001.

Thence on a New Brunswick Grid Azimuth of one hundred eighteen (118°) degrees, forty-seven (47’) minutes, twenty (20”) seconds a distance of nineteen and forty-two hundredths (19.42) metres to a standard survey monument on the northwestern side of Lot 73-28 (PID 457820) as shown on a subdivision plan registered in the Kings County registry office as Plan No. 4122.

Thence on an azimuth of two hundred nine (209°) degrees, sixteen (16’) minutes, forty (40”) seconds along the northwestern side of the aforementioned Lot 73-28 a distance of four and thirty-two hundredths (4.32) metres to the northwestern corner of Raymond and Barbara Williams property (PID 457853) having a deed registered in the Kings County registry office as instrument 11601698 in volume 1605 at page 280.

Thence on an azimuth of two hundred eight (208°) degrees, fifty-seven (57’) minutes, thirty (30”) seconds along the northwestern side of the Raymond and Barbara Williams property a distance of sixty-three and fifty-nine hundredths (63.59) metres to a standard survey monument set.

Thence on an azimuth of three hundred one (301°) degrees, forty-five (45’) minutes zero (00”) seconds crossing Prosser Court a distance of nineteen and seventy-three hundredths (19.73) metres to a standard survey monument set on the southeastern side of Lot 74-6 (PID 458406) as shown on Plan No. 4506.

Thence on an azimuth of twenty-nine (29°) degrees, thirteen (13’) minutes, thirty (30”) seconds along the southeastern side of Lot 74-6 a distance of two and fourteen hundredths (2.14) metres to the southeastern corner of Lot 74-5 as shown on Plan No. 4506.

Thence on an azimuth of twenty-nine (29°) degrees, thirteen (13’) minutes, thirty (30”) seconds along the southeastern side of Lot 74-5 as shown on Plan No. 4506 a distance of fifty-seven and fifty-seven hundredths (57.57) metres to the point of beginning.

A tract of land containing an area of 1318 square metres and being designated as Parcel “A” on a Plan of Survey showing Discontinuance of Parcel “A” (Prosser Court), situate, Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick, prepared by DeSaulniers Surveys Inc. and dated January 9, 2001. Parcel “A” is an undeveloped portion of Prosser Court as shown on Subdivision Plans Maryknoll Heights registered in the Kings County registry office as Plan No. 4122 and Plan No. 4271.
