By-Law No. 9a

The Council of the Town of Grand Bay-Westfield under authority vested in it by section 189 of the Municipalities Act, R.S.N.B. 1973, c.M-22 and amendments thereto hereby enacts an amendment to By-Law No. 9, Town of Grand Bay-Westfield By-Law Respecting The Regulation and Licensing of Transient Traders and Peddlers.

By-law No. 9 is amended as follows:

3(5). Every holder of a Peddler’s License issued under this by-law who breaks any conditions of the license by an act which is not itself punishable commits an offense punishable under part II of the Provincial Offenses Procedure Act as a Category “B” offense.

4(4). Every holder of a Transient Traders License issued under this by-law who breaks any condition of the license of an act which is not itself punishable commits an offense punishable under Part II of the Provincial Offenses Procedure Act as a Category “B” offense.

Section 5(4) is deleted and replaced with a new section 5(4) which reads as follows:

5(4). Upon being satisfied concerning the facts required in subsection 5(2) and 5(3), the Town Manager shall issue such license to the peddler or transient trader upon payment by the peddler or transient trader of a fee of one hundred and fifty dollars ($150.00).

Section 7(3) is deleted and replaced with a new section 7(3) which reads as follows:

7(3)(a). A person who violates any provision of this By-law other than a condition under which a license is issued is guilty of an offense and is liable to a fine of not less than seventy dollars ($70.00) and a maximum of two hundred and fifty dollars ($250.00) and in default of payment thereof, to prosecution in accordance with the provisions of the Provincial Offenses Procedure Act.

(b) A person who has committed a violation of any of the provisions of this by-law, other than a condition upon which a license is issued or failure to comply with a Judge’s Order, may at the discretion of the By-law Enforcement Officer pay the minimum fine prescribed and upon such payment, the person committing the violation is not to be prosecuted or further prosecuted therefor

This by-law comes into force on the date of final passing thereof.
