The Council of the Municipality of Grand Bay-Westfield under authority vested in it by Section 187 of the Municipalities Act, R.S.N.B. 1973, c.M-22 and amendments thereto enacts as follows:
All that certain portion of public street known as Hillandale Drive as described by the attached Schedule ‘A’, Plan of Survey showing Parcel 04-1, prepared by DeSaulniers Surveys Inc., dated January 19, 2004 and more particularly described as follows will on the enactment of this by-law be closed to public use:

PORTION OF HILLANDALE DRIVE TO BE CLOSED
All and singular that certain lot, piece or parcel of land being a portion of Hillandale Drive situated in the Town of Grand Bay-Westfield, Parish of Westfield, County of Kings and Province of New Brunswick. Said parcel of land being more particularly described as follows, viz:
Beginning at the point of intersection of the northeasterly side of Route 177 and the southerly side of Dallas Urquhart and Pamela Urquhart property (instrument 16040926 Effective date 2003-03-26) as shown on a plan registered in the Kings County Registry Office as Plan 4867. Said point of beginning having New Brunswick Grid Co-ordinate values (Nad83 Adj) of East 2521913.278 metres and North 7371017.003 metres and being designated as Station 264 on a Survey Plan, Parcel 04-1, being, Remnant Portion of Hillandale Drive To Be Closed To Public, situate, Route 177, Town of Grand Bay-Westfield, Parish of Westfield, Kings County New Brunswick prepared by A. Edward DeSaulniers NBLS and dated February 19, 2004.
Thence on a New Brunswick Grid Azimuth of seventy-four (74°) degrees, five (05’) minutes, fifty (50”) seconds along the southerly side of the aforementioned Dallas Urquhart and Pamela Urquhart property a distance of forty and fifty-six hundredths (40.56) metres to the southern side of Hammond Road (Humphres Road as shown on Plan No. 972). Said point having New Brunswick Grid Co-ordinate values (Nad83 Adj) of East 2521952.277 metres and North 7371028.155 metres and being designated as Station 306 on the aforementioned Survey Plan.
Thence following the southerly side of Hammond Road (Humphres Road as shown on Plan No. 972) along an arc of an eighty-nine and ninety-two hundredths (89.92) metres radius curve to the left, a distance of thirty-nine and four hundredths (39.04) metres; said arc having a chord distance of thirty-eight and seventy-three hundredths (38.73) metres measured on an azimuth of one hundred two (102°) degrees, fifteen (15’) minutes, ten (10”) seconds to the northern corner of the Dallas Urquhart and Pamela Urquhart property (instrument 16041338 Effective Date 2003-03-24). Said point having New Brunswick Grid Co-ordinate values (Nad83 Adj) of East 2521973.014 metres and North 7370981.870 metres and being designated as Station 295 on the aforementioned Survey Plan.
Thence on an azimuth of two hundred four (204°) degrees, thirteen (13’) minutes, forty (40”) seconds along the western side of the Dallas Urquhart and Pamela Urquhart property a distance of two and forty-one hundredths (2.41) metres to a point on the northern side of another property owned by Dallas Urquhart and Pamela Urquhart (deed 311253, volume 1180, page 281). Said point having New Brunswick Grid Co-ordinate values (Nad83 Adj) of East 2521989.135 metres and North 7371017.697 metres and being designated as Station 308 the aforementioned Survey Plan.
Thence on an azimuth of two hundred fifty-four (254°) degrees, five (5’) minutes forty (40”) seconds along the northerly side of Dallas Urquhart and Pamela Urquhart property a distance of fifty-eight and twenty-five hundredths (58.25) metres to a point on the northeasterly side of route 177. Said point having New Brunswick Grid Co-ordinate values (Nad83 Adj) of East 2521933.116 metres and North 7371001.735 metres and being designated as Station 286 on the aforementioned Survey Plan.
Thence following the northeasterly side of Route 177 along the arc of a one hundred twenty-four and fifty-seven hundredths (124.57) metres radius curve to the right, a distance of twenty-five and eight hundredths (25.08) metres; said arc having a chord distance of twenty-five and three hundredths (25.03) metres measured on an azimuth of three hundred seven (307°) degrees, thirty-five (35’) minutes, zero zero (00”) seconds to the point of beginning.
A tract of land containing an area of 993 square metres and being designated as Parcel “04-1” on a Plan of Survey, Parcel 04-1, being Remnant Portion of Hillandale Drive To Be Closed To Public, situate, Route 177, Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick, prepared by A. Edward DeSaulniers NBLS and dated February 19, 2004.
